Terms of Service

These terms cover your use of rchcreativesolutions.com. They do not cover project work: if we build something for you, that work is governed by a separate written agreement. By using the Site you accept these terms; if you do not, please do not use it.

1. Who we are

The Site is operated by R&CH Creative Solutions, LLC, doing business as R&CH Creative Solutions ("R&CH", "we", "us"), Florida, USA. Contact: privacy@rchcreativesolutions.com.

2. What the Site is

The Site describes our software development services and lets you contact us. Its content is general information. It is not an offer, a quote or a guarantee that we will provide any service.

3. Project Discovery and contact forms

When you complete the Project Discovery questionnaire or the contact form:

  • The brief it produces is a summary of what you told us. It is not a proposal, a price quote or a commitment by either of us.
  • Suggested first steps and any size or scope indication are informational and may change once we understand your project.
  • Sending a form does not create a client relationship, a contract, or any confidentiality obligation beyond our Privacy Policy. Please do not send trade secrets, passwords, payment card numbers, government ID numbers or health records. Share sensitive material only after we have agreed to terms in writing.
  • You confirm the information you send is accurate and that you have the right to send it.

4. Project work is governed by a separate agreement

A project begins only when both parties sign a written agreement, such as a proposal with a statement of work or a master services agreement. That agreement sets scope, fees, schedule, ownership of the work, warranties and confidentiality. If it conflicts with these terms, it prevails for that project.

5. Acceptable use

You agree not to:

  • break the law or infringe anyone's rights through the Site;
  • send spam, malware or content that is unlawful, abusive or misleading;
  • probe, scan or test the security of the Site, or try to access it without permission;
  • overload, scrape or copy the Site by automated means, except for ordinary search-engine indexing;
  • impersonate another person or give false contact details.

We may block access or remove submissions that break these rules.

6. Intellectual property

The Site, including its text, design, graphics, logos and code, belongs to us or our licensors and is protected by intellectual property laws. We grant you a limited, revocable, non-exclusive license to view the Site and print or share pages for your own non-commercial use. Nothing else is licensed. "R&CH" and our logos are our marks; do not use them without written permission.

If you send us ideas or feedback about the Site, we may use them without obligation to you. Your project ideas and materials remain yours; we will use them only to respond to you.

7. Third-party links

The Site links to other websites. We do not control them and are not responsible for their content or practices.

8. Disclaimer

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, R&CH AND ITS OWNERS, OFFICERS AND CONTRACTORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE OR DATA, ARISING FROM YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED US DOLLARS (US$100). Some jurisdictions do not allow certain limits, so parts of this section may not apply to you.

10. Indemnification

You agree to defend and indemnify us against claims, losses and reasonable legal fees arising from your misuse of the Site or your breach of these terms.

11. Governing law and disputes

These terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Courts located in Miami-Dade County, Florida, have exclusive jurisdiction over disputes about the Site, and you consent to that jurisdiction. Before filing a claim, please contact us at privacy@rchcreativesolutions.com so we can try to resolve it informally.

12. Changes, availability and termination

We may change the Site or these terms at any time. The "last updated" date shows the latest version, and continued use means you accept it. We may suspend or end access to the Site at any time.

13. General

These terms and our Privacy Policy are the whole agreement about the Site. If a provision is unenforceable, the rest stays in effect. Our not enforcing a provision is not a waiver. You may not assign these terms; we may. The English version prevails over any translation.
